What is the impact of your EPC label?

Since 2022 the energy performance certificate plays a key role in rent indexation in Flanders and Brussels. Discover the rules per label.

The limitation in Flanders

From 1 October 2022 to 30 September 2023, the right to index in Flanders was tied to the property's EPC label. The measure encouraged landlords to invest in energy-efficient homes and protected tenants of energy-hungry properties.

The rules per EPC label

During that period: labels A+, A, B and C could index fully; label D was limited to 50%; labels E and F, or no valid EPC, could not index at all. Since 1 October 2023 this limitation has ended and every landlord may index again, even without an EPC.

The correction factor since October 2023

Did your lease take effect before 1 October 2022 and does the property have label D, E, F or no valid EPC? Then you must apply a correction factor at every indexation, so the frozen period is not recovered afterwards. It keeps applying until a better EPC is presented or a new lease starts. Limitations in Brussels

The Brussels-Capital Region has applied comparable restrictions since 14 October 2022, based on the EPB certificate. Properties with the weakest labels may not index, or only partly, through an official coefficient. Brussels rules keep evolving, so stay informed.

The situation in Wallonia

Wallonia currently applies no specific EPC restrictions to indexation. The standard formula applies regardless of the energy label. This may change as Walloon legislation evolves.

What if you have no EPC?

Without a valid EPC you may index again since October 2023, but with the correction factor, which permanently dampens your indexation. A valid EPC with label A+ to C removes the factor. These rules do not apply to commercial leases.
