Indexation in Flanders, Brussels and Wallonia

Belgium has three regions, each with its own rental legislation. These differences matter for a correct calculation.

Three regions, three rulebooks

Rental law in Belgium is regionalised. Flanders applies its Residential Lease Decree, Brussels its Housing Code, and Wallonia its 2018 decree. While the basic formula is identical everywhere, the additional rules and limitations differ.

Indexation in Flanders

The strict EPC limitation of October 2022 ended on 1 October 2023. Since then every label may be indexed again, but leases that took effect before October 2022 with label D, E, F or no EPC retain a correction factor. Retroactivity is capped at three months. For residential leases from 2019 onwards, the date of taking effect serves as the starting date.

Indexation in Brussels

The Brussels-Capital Region has applied comparable EPB restrictions since October 2022, through an official coefficient. Brussels rules are often stricter, with specific provisions for renovation leases and social housing. Language requirements also differ.

Indexation in Wallonia

Wallonia currently has the most flexible rules: no specific EPC restrictions on indexation. The standard formula applies regardless of label. Here the base index follows the signing date of the lease. The 2018 Walloon decree has its own rules on duration, notice and rental deposit.

The formula is the same everywhere

Despite regional differences, the basic formula is identical across Belgium: new rent = base rent × new index ÷ base index. Statbel's health index is the reference in all three regions.

Language requirements per region

In Flanders leases are generally in Dutch, in Wallonia in French. In Brussels the tenant is entitled to a contract in their own language. Our indexation letters are automatically drafted in the tenant's language.
